Terms for BotMine, bot hosting, digital packages, addons, and marketplace features.
Scope
These Terms apply to BotMine, including account features, hosted Discord bots, packages, addons, digital content, marketplace features, and support services.
Different user terms apply only if BotMine expressly confirms them in text form.
BotMine may be used by consumers and businesses. A business is any natural or legal person acting in the exercise of commercial or independent professional activity when entering into the contract.
Contracting party and conclusion
The provider and contracting party is SouthLayer / Marco Hotz, sole proprietorship, c/o Adressgeber #1943, An der Alten Ziegelei 38, 48157 Münster, Germany. Contact: legal@layerdns.net.
The contract language is German unless another language is expressly agreed.
Displayed prices, packages, addons, and plans are not binding offers, but invitations to place an order.
A contract is concluded when BotMine confirms the order, grants digital access, or the payment has been processed successfully.
BotMine may reject orders if technical, legal, security, or operational reasons prevent fulfillment.
Service and availability
BotMine is a managed Discord bot service with hosting, runtime, dashboard, logs, bot management, addon installation, entitlements, and related digital services.
The concrete scope depends on the selected plan, package, addon, or product description shown during checkout.
BotMine aims to operate reliably. Maintenance, security updates, third-party incidents, Discord API changes, or infrastructure issues may affect availability.
BotMine may change, replace, or restrict features where required for technical, legal, security, or operational reasons while reasonably considering legitimate user interests.
User obligations
Users must comply with applicable law, Discord rules, platform limits, third-party rights, and these Terms.
Bot tokens, API keys, access data, and admin permissions must be kept confidential and protected from unauthorized access.
Spam, malware, phishing, bypassing security controls, abusive automation, unlawful content, and conduct that harms BotMine, Discord, or third parties are prohibited.
Users are responsible for their content, configurations, addons, bot behavior, and uploaded files.
Users must notify BotMine without undue delay if they notice a security incident or suspected abuse and must take reasonable mitigation steps.
Packages, addons, and entitlements
Access to plans, packages, addons, and features is technically represented by entitlements. Scope, term, quantity, slots, and target binding depend on the respective entitlement.
One free package may be active per account unless another rule is expressly shown.
Addon slots may be limited by entitlements. Without a slot-limit entitlement, installation may be technically unlimited as long as no other security or platform limits apply.
User-owned addons may be installed without a purchase entitlement if the user is authorized and any bot-wide slot limits are not exceeded.
BotMine may review, reject, hide, or remove addons if security, quality, legal, or platform reasons apply.
Marketplace and user addons
Users may create addons and submit them for review where the feature is enabled.
Creators are additionally subject to the separate Marketplace and Creator Terms.
By publishing an addon, the user grants BotMine the rights required to display, store, technically provide, review, and install the addon on bots.
The user confirms that they hold the required rights to the addon and that it does not infringe third-party rights.
BotMine does not owe permanent publication, placement, promotion, or a specific number of installations.
Security-relevant addons, harmful code, misleading descriptions, or policy violations may be removed or blocked.
Prices, payment, and invoices
Prices are shown during checkout. VAT, tax notes, payment method, and total amount are shown in checkout and on the invoice.
Payments are processed through integrated payment service providers, especially Mollie. Payment provider fees never reduce the invoice amount.
Invoices are created after successful payment, numbered sequentially, and made available in the account or billing area where technically available.
Failed, canceled, or unconfirmed payments do not create a claim to access or activation.
BotMine may review payments, orders, and entitlements and correct, block, or reverse them where legally or accounting-wise required.
Term, renewal, and termination
Prepaid terms are paid in advance and generally run until the end of the paid term. Cancellation does not end the service immediately; it prevents further renewal or reactivation after expiry.
When a bot-plan entitlement expires, the affected bot may be stopped or disabled. Bot configuration and related data may be kept for a reasonable grace period and then deleted or archived unless legal retention duties apply.
Upgrades may take effect immediately or from the next term depending on the product. Downgrades generally take effect at the end of the paid term unless checkout states otherwise.
Failed, canceled, or charged-back payments do not activate access. Active services may be suspended for payment issues, suspected fraud, or chargebacks.
Reactivation after expiry or suspension may require a new order, successful payment, and technical review.
Ordinary termination is generally effective at the end of the paid term. There is no automatic refund unless required by law or expressly granted by BotMine.
The right to terminate for cause remains unaffected.
Withdrawal for digital content
Consumers generally have a statutory right of withdrawal.
For digital content and digital services, the withdrawal right may expire if the user expressly agrees that BotMine starts performance before the withdrawal period ends and confirms that this causes the loss of the withdrawal right.
Where a withdrawal right applies, statutory information is provided during checkout or in a separate withdrawal notice.
Refunds and voluntary refunds are additionally governed by the separate withdrawal and refund notice.
Suspension and security
BotMine may temporarily suspend accounts, bots, addons, tokens, marketplace entries, or entitlements if there are concrete indications of abuse, security risks, payment issues, or legal violations.
Where possible, BotMine will inform the affected user about the reason and expected duration.
Suspensions may occur without prior notice if required to mitigate acute risks.
Liability
BotMine is fully liable for intent, gross negligence, injury to life, body, or health, and under mandatory statutory law.
For slight negligence, BotMine is liable only for breach of material contractual obligations and limited to typical, foreseeable damage.
For user-provided content, addons, bot configurations, Discord changes, third-party outages, and external integrations, BotMine is liable only under applicable law.
Strict liability for initial defects is excluded to the extent legally permitted.
Privacy and confidentiality
Information on personal data processing is available in the privacy policy.
BotMine processes technical data, account data, invoice data, payment references, entitlements, bot configurations, and audit data where required for operation, security, billing, and traceability.
Users must not store sensitive data in addon configurations, bot names, support tickets, or marketplace descriptions unless expressly intended and secured.
Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the user's habitual residence remain unaffected.
Where legally permitted, the place of jurisdiction for merchants, public-law legal entities, or special public-law funds is the provider's seat.
If individual provisions are invalid, the remaining provisions remain effective.
BotMine may amend these Terms only where objective reasons exist, such as legal changes, security requirements, new features, technical changes, or changed case law.
Users are informed about material changes with reasonable notice in text form or in the account. The notice describes the changes, effective date, and termination or objection options.
Material core services, prices, or already paid terms are not unilaterally changed to the user's disadvantage without a valid legal basis.
